- Scope and Contracting Parties
These Terms and Conditions apply to all contracts concluded between Skinpoemstudio (hereinafter referred to as “we” or “us”) and the consumer (hereinafter referred to as “you”) via the website www.skinpoemstudio.com. A “consumer” is defined as any natural person acting for purposes that are outside their trade, business, craft, or profession.

- Conclusion of Contract
A contract is formed when you place an order through our website and we accept that order. We accept the order when we send a shipping confirmation notification to the email address you provided at the time of ordering. This confirmation email constitutes our acceptance of your offer. - Prices and Payment
All prices are quoted in Euros and include applicable German VAT. The price payable is the price displayed at the time you submit your order. Unless otherwise agreed in writing, payment must be completed prior to shipment. - Delivery
4.1 Delivery Partners
We use reputable carriers (including DHL, FedEx, and UPS Priority services) for order delivery. We select the carrier based on the destination and the nature of the goods.
4.2 Delivery Times
For deliveries within Germany, the standard delivery time is 5–12 business days from the date of shipment. Delivery times to other European destinations may vary; we will provide information on this where feasible.
4.3 Tracking Notifications
We will send automated tracking notifications to the email address provided at the time of ordering at key stages of the delivery process—including shipment, arrival at the carrier’s local facility, and local delivery. These notifications are intended to keep you informed of the delivery progress.
4.4 Delays and Investigations
If the delivery time exceeds the standard timeframe mentioned above, we will initiate an investigation with the carrier. Upon completion of the investigation, and depending on the specific circumstances, we may offer a full refund or arrange for a replacement shipment. The choice between a refund and a replacement shipment will be determined based on factors such as the nature of the goods and the availability of replacement stock.
5. Risk and Ownership
5.1 Transfer of Risk
The risk of loss of or damage to the goods passes to you only when you (or a third party other than the carrier designated by you) acquire physical possession of the goods. This applies even if possession of the goods had previously passed to the carrier. We bear the risk until actual receipt of the goods.
5.2 Ownership
Ownership of the goods passes to you upon full payment of the purchase price and actual delivery of the goods to you or a third party designated by you.
- Right of Withdrawal
6.1 Statutory Right
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party other than the carrier designated by you) acquire physical possession of the goods.
6.2 How to Exercise
To exercise your right of withdrawal, you must inform us by sending a clear statement to staff@skinpoemstudio.com. You may choose to use the standard withdrawal form, but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
6.3 Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We will make the reimbursement without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
6.4 Return of Goods
You must send back or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods.
6.5 Diminished Value
You are liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods. If the manner of handling goes beyond what is typically permitted in a physical store, it may give rise to a claim for diminished value.
- Defective or Damaged Goods
7.1 Notification
If the goods you receive are defective, damaged, or do not conform to the contract, you may contact us at staff@skinpoemstudio.com within a reasonable time after discovering the issue. Please provide photographic evidence of the defect or damage so that we may promptly assess the situation.
7.2 Remedies
Upon verification of the defect or damage, you may choose repair, replacement, or a refund, in accordance with your statutory rights. If the provided evidence confirms the existence of the defect, we may offer a refund or replacement without requiring the return of the defective or damaged goods. We reserve the right to waive the return requirement in specific cases; such a waiver does not create an obligation for us to do so in other instances.
7.3 Statutory Rights
Nothing in these terms limits your statutory rights under German law regarding goods that do not conform to the contract. The statutory warranty period for goods is two years from the date of delivery.
- Limitation of Liability
8.1 Exclusions
We are not liable for any delay or failure to perform caused by events beyond our reasonable control (including, but not limited to, service interruptions by carriers, customs procedures, or natural disasters).
8.2 Scope of Liability
For breach of contract, our liability is limited to the purchase price of the relevant goods; however, we accept unlimited liability as required by law in cases of willful misconduct, gross negligence, or injury to life, body, or health. This limitation of liability does not apply to any mandatory statutory liability.
- Language and Applicable Law
9.1 Language
All communications and these terms are conducted in English. Where required by applicable law, we will provide a German version of mandatory information.
9.2 Governing Law
These terms are governed by the laws of the Federal Republic of Germany. If you are a consumer residing in another EU Member State, you benefit from the mandatory protections afforded by the laws of your country of residence. Nothing in these terms affects your consumer rights under such mandatory provisions.
- Changes to These Terms
We reserve the right to amend these terms from time to time to reflect changes in legal requirements or business practices. The version in effect at the time you place your order applies to that order.
